By booking, paying for, participating and/or being a part of a tour or any event (as a passenger, guest or otherwise) promoted, created, managed, administered or otherwise facilitated with Noricum Travel (a brand managed by Domicijan d.o.o.), You (as that term is defined herein) agree to and accept the following terms and conditions. This agreement is between You, the participating passenger(s), the person or entity who booked and/or is paying Noricum Travel and/or or any agent that is booking and/or paying Noricum Travel in your or any passenger’s name (henceforth individually and collectively referred to as “You” or “Your”) and Domicijan d.o.o., Pante 11, 4000 Kranj, Slovenia (henceforth referred to as “Domicijan”).
1. BOOKING AND PAYMENTS
1.1 To make a booking for or otherwise participate and/or be a part of any Domicijan tour or event, You hereby agree to the terms and conditions listed below. Your reservation is not guaranteed until You receive a confirmation from Domicijan. Domicijan accepts a booking on the understanding that full payment has been/will be collected and held either by Domicijan directly, or by one of our authorized sales agents or partners.
1.2 Upon confirmation from Domicijan, Domicijan will reserve a space for You on the selected trip or event. It is Your sole responsibility to check the accuracy of the booking and the dates of travel. Domicijan reserve the right to accept or reject any booking for any reason, including but not limited to Your failure to make timely payments to Domicijan, Your cancellation or rescheduling of the trip or event or the lack of space on the desired trip or event.
1.3 Once Your online booking is complete in all respects, Domicijan will issue You a confirmation voucher and send it to the email address You have provided. Please contact us if You do not receive a booking confirmation, as it might mean that Your order has not been successfully processed or there are internet communication problems. If You do not receive a written confirmation, please check Your junk email folder to see if the email has landed there, then please also check that the email address You entered was indeed the correct one. If You have not received the written confirmation from Domicijan, please email us at info@noricumtravel.com giving us Your full name, the tour or event You booked (including as much specifics (time, date, etc.) as possible) and request that Domicijan resend You the confirmation voucher.
1.4 We accept Visa, Visa Electron, MasterCard, Maestro and American Express.
1.5 By booking any product through the Domicijan website, You grant Domicijan permission to contact You directly by email.
2. DESCRIPTION OF SERVICES
2.1 Domicijan offers day trips, city breaks, specials, day trips packages and tours with transportation, professional guides, attraction fees as stated in day trip’s itinerary.
2.2. City breaks and tours can be booked with accommodation, which is, upon agreement with You, booked by Domicijan and provided by a third party – accommodation providers.
3. CONTRACTING PARTIES
3.1 The booking conditions detailed herein contain the entire contract between You and Domicijan. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.
3.2 Your contract is with Domicijan d.o.o. Domicijan reserves the right to nominate to you in writing any other company or person to have the benefit of some or all of the provisions of this contract, which Domicijan may then specify, as if you had agreed to the provisions concerned directly with that company or person.
3.3 In case Domicijan acts as a booking agent and contracts directly with coaches, boats, hostels, hotels and other service providers (individually and collectively the “Other Providers”), all bookings with the Other Providers are subject to their terms and conditions and limitations of liability and Proteus makes no warranties or representations or assumes any liability in connection with the activities of the Other Providers. It is important to note that some of the Other Provider may limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Proteus does not accept any responsibility for any loss as a result of such actions or as a result of any act or omission of the Other Providers and You agree that Proteus is not responsible for the acts or omissions of the Other Providers.
3.4 The accommodation arrangements provided by Domicijan are contracted to Other Providers. They are subject to the terms and conditions, and limitations of liability, imposed by the Other Providers. All arrangements are made independently of Domicijan, regardless of the booking of such arrangements by Domicijan.
4. PASSENGER RESPONSIBILITIES
4.1 It is Your responsibility to make sure you have a valid passport, and all necessary visas, permits or certificates on Your person for Your selected trip. Domicijan is not liable for any problems, delays or denied entry in the event You are not in possession of valid travel documents.
4.2 EU nationals holding a passport or national ID card are not required to show a passport or national ID card if travelling from one border-free Schengen country. For Australian, British, Canadian or American nationals it is required to hold a passport valid for three months beyond the length of stay and issued within the past 10 years. Croatia, Bulgaria, Cyprus, Ireland, Romania and the UK are not a part of the Schengen area, so a passport or ID card is required if travelling to/from these countries.
In case You are not sure whether you need a visa to enter the Republic of Slovenia, check with the Ministry of Foreign Affairs. Third-country nationals must hold a visa in order to enter the Republic of Slovenia.
Tour participants under 18 must be accompanied by an adult. While booking it is Your obligation to provide Domicijan information whether participant is obliged to have child car seat. Domicijan reserve the right not to allow to participate on the tour children for which child car seat was not asked for in advance (at least 24 hours before departure).
Any disability requiring special attention must be reported at the time of booking. We will make reasonable efforts to accommodate the special needs of disabled participants; however we are not responsible for any denial of services by carriers, hotels, restaurants, motor coaches, mini buses, vans and cars which are not equipped with wheelchair ramps. We cannot provide individual assistance to a tour member for walking, dining, getting on/off transportation vehicles, or other personal needs.
Travelers who need assistance must be accompanied by a qualified and physically able companion.
4.2 You agree to comply with the authority and direction of the Domicijan guides or Domicijan office support, and the laws and regulations of the countries visited, including customs and foreign exchange restrictions.
4.3 There may be times when the Domicijan guide must make a decision for the safety and/or the best interests of the group. It is a condition of booking that You comply with the authority and decisions of the Domicijan guide and You do agree to comply with such authority and decisions. If You do not comply, or if in the good faith opinion of the Domicijan guide You are not compatible with the general enjoyment of the group or the smooth operation of the tour (for reasons including but not limited to intoxication, lewd or inappropriate language or behavior, etc.), Domicijan reserves the right to refuse to allow You to continue with the tour or the event. You agree that Domicijan has the exclusive right to dispel and remove You from a tour or event anytime, without any claims or complaints by You against Domicijan. In such a case Domicijan will not be liable for any refund, compensation, or additional costs incurred by You.
4.4 It is Your responsibility to meet the transportation provided by Domicijan at the correct time and location for departure. In the event You miss a planned departure, any extra travel costs incurred are Your sole responsibility and paid by You. Passengers who miss a departure time due to delay or cancellation of incoming transportation are not entitled to a refund. It is Your responsibility to check in with the Domicijan office 15 minutes prior to the specified departure time/start of the event. Due to the nature of the services provided, Domicijan will not be liable for any damage or costs You may incur if any service departs, starts, arrives or ends later than the specified time, even if as a result You miss a connecting service or some other scheduled event.
4.5 Domicijan is not responsible for Your personal belongings. It is Your sole responsibility to look after Your belongings yourself. You agree that Domicijan is not responsible for loss, theft or damage to any of Your personal belongings, regardless of the circumstances.
4.6 The products offered by Domicijan are day trips, city breaks, specials and tours consisting of transportation, guidance and (if arranged) accommodation. Domicijan guides cannot offer constant special attention or assistance should You have any physical disability requiring such attention without prior arrangement. In such circumstances, it is within Domicijan rights to refuse to allow You to continue with the tour or the event.
4.7 You agree that Domicijan may take photographs and films of You while You are participating on a Domicijan trip. You agree that these photographs and films may be used for marketing and promotional purposes by Domicijan. These photographs and films may be used in, but are not limited to, brochures, websites, print media and promotional videos. These photographs and films may be used for publicity and advertising without Domicijan obtaining further consent from You or making any payment to You in connection with the permitted uses.
5. LOCAL PROVIDERS
5.1 You will have the opportunity to purchase from Domicijan services from local providers at Your chosen destination. These services are not included in the price of your travel package (unless otherwise stated). You are responsible for any additional costs.
5.2 Services from local providers purchased by You are run by local operators and You are subject to their terms and conditions.
5.3 Services from local providers purchased through Domicijan are non-refundable and non-transferable. It is Your responsibility to meet the tour or event at the designated departure point and time.
5.4 It is Your responsibility to keep track of any local providers’ vouchers or tickets issued to You by Domicijan. Lost vouchers or tickets cannot be replaced.
6. INSURANCE
6.1 There is no travel insurance included in the cost of any Domicijan tour, event or package, ticket or product. You acknowledge that any insurance that You wish to obtain in connection with any Domicijan tour, event or package is Your sole responsibility.
6.2 Nevertheless, Domicijan highly recommends that You purchase Your own travel insurance that covers all of Your travels. Domicijan strongly recommends that You are covered by a comprehensive insurance policy which includes: personal accident, medical expenses, personal baggage, money and public liability.
6.3 Travel Guarantee
Our company is insured for insolvency. This guarantees the amount that You paid in booking Your travel package as well as Your repatriation in the event of insolvency by Domicijan. You agree that this the only amounts that Domicijan is liable to pay to You in connection with the tour, event or package that You book.
7. WEATHER, ENVIRONMENTAL AND POLITICAL CONDITIONS
7.1 Domicijan is not responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be cancelled or changed by You at anytime on the basis of weather conditions.
7.2 Domicijan is not responsible for delays due to labor disputes, border problems or other political factors.
7.3 Domicijan is not responsible for delays due to mechanical failure, or other issues that may arise and are outside of Domicijans’ control.
8. CANCELLATIONS/CHANGES
8.5 To cancel or change a booking You must notify Domicijan via email no later than two (2) days before the time the trip or event is scheduled to depart or take place. Depending on the time of cancellation the following cancellation costs apply:
For multiple day tours:
90% of the deposit will be refunded for cancellations between 60-31 days before departure
75% of the deposit will be refunded for cancellations between 30-20 days before departure
50% of the deposit will be refunded for cancellations between 19-5 days before departure
25% of the deposit will be refunded for cancellations between 4-3 days before departure
None (0%) of the deposit will be refunded for cancellation on less than 3 days notice before the day of departure or no-show
For daytrips:
100% of the payment will be refunded for cancellations up to 24 hours before departure
None (0%) of the payment will be refunded for cancellation on less than 24 hours notice before the day of departure or no-show.
8.6 No refunds will be made in respect of any unused portion of a ticket or partially completed trip.
8.7 Although unlikely, tours may be canceled/changed by Domicijan due to lack of the minimum number of participants or other unforeseen circumstances. Domicijan reserves the right to cancel/change tours up to but not less than 12 hours prior to the time of departure. In the event a tour is canceled/changed, You will be notified via email or phone. In the event of a cancellation by Domicijan You will receive a full refund for the amount paid.
8.8. Should You not be able to attend a tour or event, or we are unable to offer a tour or event, due to a circumstance beyond our control or a force majeure event, Domicijan has no responsibility for tour cancellations, and You will not be entitled to any refunds.
9. COMPLAINTS PERIOD
9.1. You must notify Domicijan in the shortest amount of time possible of any irregularities that might occur during a tour or event. Domicijans’ responsibility is to eliminate any such irregularity in the shortest amount of time possible.
9.2. In the event that any irregularities were not eliminated on the spot, You can complain and request a refund or compensation after completion of a tour or event. You need to file a complaint in written form in no more than one (1) month after completion of a tour or event.

11. APPLICABLE LAW & JURISDICTION
11.1. Domicijan services are governed exclusively by the substantive laws of the Republic of Slovenia to the exclusion of conflict of law legislation as well as international law. The courts of Kranj, Slovenia, shall have exclusive jurisdiction for all disputes. To the extent permitted by law, the courts of Kranj shall be competent.
12. PRIVACY POLICY
12.1. Domicijan respects the privacy of the visitors of its website and ensures that personal information you submit to us will be treated confidentially. Processing of personal data is carried out in agreement with the requirements set by the Personal Data Privacy Law of the Republic of Slovenia and other Slovene and European legislation.
13. FINAL PREMISES
13.1. Participation in any of our tours, events and/or services is strictly voluntary. As in all human endeavors, there is a level of risk. We do our best to keep the risk at a minimum. Domicijan, its contractors, parent and subsidiary companies, and employees assume no liability or responsibility for any injury, loss, damage, inconvenience, sustained by any person using its services. We will not be held in any way responsible for injuries to body, person, or property incurred during the tour. We reserve the right to deny participation to anyone for any reason at any time.
